The judge granted an immediate injunction blocking the unconstitutional law, which banned smokable hemp products. 

In an attempt to revive the hemp flower ban, the state of Indiana is appealing the decision under the argument that the state has the right to restrict hemp products. 

For the time being, smokable hemp flower is legal in Indiana. We’re left to see if the state’s attempt to revive the decision will be successful. 

The Indiana Industrial Hemp Act defines hemp as “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than three-tenths of one percent (0.3%) on a dry basis, for any part of the Cannabis sativa L. plant.“ [1]
